Section 116
Case not withdrawn

(1) A case which has been filed once in the court for an offense under Schedule-1 or Schedule-2 cannot be withdrawn.
(2) Notwithstanding anything contained in sub-section (1), a case other than the following may be withdrawn:-
(a) false passport or citizenship, immigration, prostitution, human trafficking and smuggling, drug trafficking or dealing, illegal hunting and trade in wild animals, poisoning of public consumption goods, killing by using poison or by cruel, inhuman manner or control; , Asset Laundering, Ancient Monument Preservation Case,
(b) Sections 52 and 56 of Section-2 of Part-2 of the Criminal Code, Sections 129, 130, 131 and 134 of Section-6, Sections 138, 139 and 141 of Section-7, Section-8, Section-10 of the Criminal Code 167, Section 192A of Paragraph-14, Section 206 of Paragraph-16, Paragraph-17, Subsections (1), (2) and (3) of Section 219 of Paragraph-18, Sections 230 and 231 of Paragraph-19 and Case related to offense under Section 256 of Chapter-22,
(c) If the withdrawal of the case adversely affects the property rights of a person, the case where such person does not have consent to that extent.
(3) The Government of Nepal shall make a guideline with the necessary criteria regarding the case to be withdrawn according to sub-section (2). Can do.
(5) If the Government of Nepal decides to withdraw a case according to sub-section (4), an application with the reasons for withdrawing the case must be submitted to the relevant court through the Attorney General or a government lawyer authorized by him.
(6) If an application is received in accordance with sub-section (5), the court shall conduct a hearing before ordering the withdrawal of the case.
(7) After the hearing according to sub-section (6), if it is deemed appropriate to order the withdrawal of the case, the relevant court may order that the case be withdrawn.
(8) Notwithstanding anything contained elsewhere in this section, the pending case shall not be withdrawn in the course of appeal, examination or review or in the case of repetition of the case.
